Terms of use · GenetixBay

The deal, in plain words.

These terms are the agreement between you and GenetixBay when you use genetixbay.com, genetixbay.ca, our emails or the GenetixBay app. Please read them; we've kept them as short and clear as we can.

The short version

  • Adults only, and local law comes first. You must be of legal age where you live (21+ in the US; 18+ in Alberta, 21+ in Quebec and 19+ in the rest of Canada), and you're responsible for following the law there.
  • GenetixBay never sells or handles cannabis, seeds, clones or plants. The Seed Club runs through a licensed partner.
  • You own what you post. You give us permission to show it on GenetixBay. Contributions to the shared archive stay open for everyone.
  • Pearls are points, not money. They have no cash value.
  • Nothing here is medical or legal advice. Greenleaf can be wrong; check the sources.
  • Be decent. Follow the community guidelines, or we may limit or close your account.

This agreement

These terms are between you and [ENTITY NAME], [GB_POSTAL_ADDRESS]. By using GenetixBay you agree to them, to the community guidelines and, if you back the build, to the Fund the Bay terms. Our privacy policy explains how we handle your information.

If we change these terms in a meaningful way, we'll tell you by email and on the site at least [30 DAYS] before the change takes effect, and say what changed. If you don't agree, you can close your account before then. [COUNSEL: notice rules for amending consumer contracts, including Quebec.]

Who can use GenetixBay

  • You must be of legal age where you live: 21+ in the US; 18+ in Alberta, 21+ in Quebec and 19+ in the rest of Canada. We may ask you to confirm your age again before some features.
  • You're responsible for knowing and following the laws where you live, including laws on growing, possessing and transporting cannabis and seeds. Some features open only in some states and provinces, and may change or close when laws change.
  • GenetixBay is built for the United States and Canada. Information features are open to adults elsewhere, but regional features are not.
  • One person, one account. You can't use GenetixBay if we've banned you before.

Your account

  • Give accurate information, including your real date of birth. It's never shown to anyone.
  • You sign in with links sent to your email, so keep that inbox secure. We strongly recommend turning on two-step sign-in.
  • You're responsible for what happens on your account. If you think someone else got in, tell us straight away at security@genetixbay.com.
  • Your handle must not impersonate a breeder, a lab, our staff or anyone else.
  • You can delete your account at any time from your settings or by emailing support@genetixbay.com.

What GenetixBay is, and isn't

GenetixBay is a community, a knowledge base, a permanent genetics archive and a set of grow tools, including Jardin, our grow hardware. GenetixBay does not sell cannabis, seeds, clones, plants or any controlled substance, and never handles, stores or ships seeds.

Members may not buy, sell or offer cannabis, seeds, clones or plants on GenetixBay, except through features we've built for that purpose where the law allows it.

Marketplace, the Swap and the Seed Club

  • Availability listings. A genetics record may show where seed is available from licensed sellers in your region. Those sellers, not GenetixBay, are responsible for what they sell. A listing is not an endorsement.
  • The Seed Club runs through [SEED CLUB PARTNER], a licensed partner that sells and ships under its own licence and terms. Your purchase contract is with that partner. GenetixBay never touches the seeds.
  • The Swap and any other feature that involves genetics open only in regions where counsel confirms they're legal. You're responsible for following the rules where you and the other member live.
  • Laws on seeds are changing, including in the United States. We may pause or close these features in any region at short notice to keep everyone within the law.

How to behave

The short version of our community guidelines:

  • No sales or sourcing outside the features built for it, and no flower, concentrate, clone or plant sales anywhere.
  • No doxxing, no addresses, no photos of people without their consent, and nobody under the legal age.
  • No medical claims as fact and no legal advice.
  • No impersonation, harassment, slurs or brigading.
  • No spam, no scraping of members' personal information, no malware, and no attempts to break or overload the service.
  • Provenance claims need a source. Fabricating evidence means a permanent ban.

Your content

You own what you post: journals, photos, posts, comments and records.

So we can run the service, you give GenetixBay a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example, resize, format or translate) and distribute your content on GenetixBay and in previews of it (such as share cards), for as long as it's on the service and for a reasonable time afterwards in backups. We show it to other members according to the visibility you choose.

Shared archive. Some contributions become part of the open, permanent record: genetics records, lineage claims and their evidence, corrections, and answers you mark for the knowledge base. You license those under [CC BY-SA 4.0], the same licence as our knowledge base, so the archive stays open for everyone. If you delete your account, your personal details are removed from them, but the record stays. [COUNSEL/OWNER: confirm this licence and its scope.]

You promise you have the right to post what you post, and that it doesn't break anyone's rights or the law. Where the law allows, you agree not to assert moral rights against the formatting and translation we do to show your content. [COUNSEL: moral-rights wording for Canada and Quebec.]

If you send us ideas or feedback, we can use them without owing you anything.

Our content

The knowledge base text is licensed under Creative Commons Attribution-ShareAlike 4.0, as each article states. The editorial policy explains how to credit it.

The GenetixBay and Jardin names, Professor Greenleaf, our logos, artwork, software and site design are not covered by that licence. Please don't use them in a way that suggests we endorse you.

Pearls

Pearls are GenetixBay's points. They come in two kinds:

  • Wild Pearls are earned by contributing. You can give them to other members.
  • Cultured Pearls are bought. They're store credit on GenetixBay only and never transfer.

Pearls have no cash value. They aren't money, a currency, a security or an investment. You can't sell them, cash them out or trade them for money, inside or outside GenetixBay, except where the law requires a refund. Cultured Pearls don't expire. [OWNER: expiry rule for Wild Pearls, if any.]

We may change how many Pearls things earn or cost, with notice. We may remove Pearls earned by mistake, fraud or abuse. If your account is closed, unused Wild Pearls end; for unused Cultured Pearls, [COUNSEL: refund rule for prepaid credit when an account closes, including Quebec and other prepaid-card laws].

No medical, legal or professional advice

Everything on GenetixBay is general information about growing plants. It is not medical advice, and nothing here says cannabis treats, cures or prevents any condition. It is not legal advice either: laws differ by place and change often, so check the rules where you live.

Professor Greenleaf's answers are generated automatically from our knowledge base. They can be wrong or out of date, so check the cited sources before you act. Growing involves electricity, water, chemicals and heat; follow safety instructions and use good judgement.

Jardin hardware

Jardin kits and accessories will come with their own sales terms, safety instructions and warranty, which we'll publish before checkout opens. [COUNSEL: hardware sales terms and warranty, including statutory warranties in Quebec and other provinces and states.] Reservations made now are covered by the Fund the Bay terms.

Moderation, suspension and closing accounts

We may remove content, limit features, or suspend or close an account that breaks these terms or the guidelines, or when the law requires it. We'll tell you what happened and why, unless the law or someone's safety prevents it. You can appeal any decision once; a different moderator reviews it, and we aim to reply within 72 hours.

You can stop using GenetixBay at any time. Sections that by their nature should continue (the shared-archive licence, the Pearls rules, liability and disputes) continue after your account closes.

Disclaimers and limits of liability

We work hard to keep GenetixBay accurate and running, but we provide it “as is”. To the extent the law allows, we don't promise it will always be available, error-free or fit for a particular purpose.

To the extent the law allows, GenetixBay isn't liable for indirect or consequential losses (such as lost crops or profits), and our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and [US$100 OR CA$100].

Nothing in these terms limits rights you have under consumer protection law where you live, including the Quebec Consumer Protection Act, and nothing excludes liability that the law doesn't allow us to exclude. [COUNSEL: review all limitation and indemnity wording.]

If you break these terms or the law and that causes a claim against us, you agree to cover our reasonable costs, except where consumer law doesn't allow this.

Governing law and disputes

If something goes wrong, please email us first; most problems are solved quickly that way.

These terms are governed by the laws of [GOVERNING LAW], and disputes go to the courts of [VENUE], unless the law where you live gives you the right to use your local law and courts. If you live in Quebec, Quebec law applies and you can go to the Quebec courts. [COUNSEL: governing law and venue for US and Canadian consumers; whether to use arbitration (not allowed against Quebec consumers) and any class-action waiver.]

Language

These terms are available in English and French. The French version is a machine-made draft until a human translator reviews it. [COUNSEL: Quebec Charter of the French Language requirements for contracts of adhesion, and which version governs.]

Everything else

If part of these terms is found unenforceable, the rest still applies. If we don't enforce a term right away, we haven't given it up. We may transfer these terms to a company that takes over GenetixBay, and we'll tell you if we do. These terms, the guidelines and the policies they link to are the whole agreement between us about the service.
